Help! I recently had my oil changed at .....well maybe I shouldnt say yet, but they did a sloppy job with the whole check up on my car, to include not draining the old oil...( you can look at the plug and tell it hasnt been touched) and adding new oil to the point that it was 4 qts over full. Well within 4 days my car slung a rod. I didnt know it was over full prior to this, but so much oil blew out and there was oil everywhere and i know a good 3 qts on the ground where the car sat, plus the dip stick still read slightly over full. Now they are trying to say that that over filling an engine will do no more damage than blowing a few seals, however there is a whole in the side of the block you can stick your intire hand in. You can look up into the engine and see the crank and the rod missing. Is it possible for overfilling to cause this much damage, and does anyone have some sites that would show this information??

Being that overfull the crankshaft and connecting rods were beating the oil into an aerated foamy mess. Air is not a good lubricant. Your engine had catastrophic failure due to inadequate lubrication from the foaming causing a bearing or connecting rod to fail sending a rod through your block(this is common on oil starvation issues as well.

This is directly related to the car being overfilled by 4 qts. You have a case. Do not back down until you are compensated for your loss of transportation and the repair and replacement of the engine or vehicle.
I would recommend to build a file first before taking any steps to court. Start collecting and documenting everything around this matter, so you have at least the proper amount of paperwork to back up your story. Also make sure that you have a record of performed scheduled servicing. When this lacks, it could break down your case.

A statement from the shop would also be helpful, even when they deny any liability.
